Issue in Substitution for Lost Certificates Etc. (1) If any Warrant Certificate becomes mutilated or is lost, destroyed or stolen, WorldHeart, subject to applicable law and to Subsection 2.11(2), shall issue, and thereupon the Warrant Agent will certify and deliver, a new Warrant Certificate of like tenor and for the purchase of a like number of Common Shares as the one mutilated, lost, destroyed or stolen in exchange for and in place of and on surrender and cancellation of such mutilated Warrant Certificate or in lieu of and in substitution for such lost, destroyed or stolen Warrant Certificate and the substituted Warrant Certificate shall be in a form approved by the Warrant Agent and the Warrant evidenced thereby shall entitle the holder to the benefits hereof and rank pari passu in accordance with its terms and with all other Warrants issued hereunder.
Issue in Substitution for Lost Certificates Etc. 2.10.1 If any Special Warrant Certificate becomes mutilated or is lost, destroyed or stolen, the Corporation, subject to applicable law and to Section 2.10.2 hereof, will issue, and thereupon the Special Warrant Agent will certify and deliver, a new Special Warrant Certificate of like denomination and tenor and bearing the applicable legends as the one mutilated, lost, destroyed or stolen in exchange for and in place of and on surrender and cancellation of such mutilated certificate or in lieu of and in substitution for such lost, destroyed or stolen certificate and the Special Warrants evidenced thereby shall be entitled to the benefits hereof and shall rank equally in accordance with its terms with all other Special Warrants issued or to be issued hereunder.

(1) If any Warrant Certificate becomes mutilated or is lost, destroyed or stolen, Crystallex, subject to applicable law and to subsection (2), will issue, and thereupon the Warrant Agent will certify and deliver, a new Warrant Certificate of like tenor as the one mutilated, lost, destroyed or stolen in exchange for and in place of and on surrender and cancellation of such mutilated Warrant Certificate or in lieu of and in substitution for such lost, destroyed or stolen Warrant Certificate.

(1) If any Special Warrant Certificate becomes mutilated or is lost, destroyed or stolen, AltaRex, subject to applicable law and to Subsection 2.11(2), will issue, and thereupon the Trustee will certify and deliver, a new Special Warrant Certificate of like date and tenor as the one mutilated, lost, destroyed or stolen in exchange for and in place of and on surrender and cancellation of such mutilated Special Warrant Certificate or in lieu of and in substitution for 13 -12- such lost, destroyed or stolen Special Warrant Certificate and the substituted Special Warrant Certificate shall be in a form approved by the Trustee and shall entitle the holders to the benefits hereof and rank pari passu in accordance with its terms and with all other Special Warrants issued hereunder.

Issue in Substitution for Lost Certificates Etc. (a) Substitution: If any Subscription Receipt Certificate is issued and it becomes mutilated or is lost, destroyed or stolen, the Company, subject to applicable law and to Section 2.06(b), will issue, and thereupon the Subscription Receipt Agent will certify and deliver, a new Subscription Receipt Certificate of like tenor and bearing the same legends as the one mutilated, lost, destroyed or stolen in exchange for and in place of and on surrender and cancellation of such mutilated certificate or in lieu of and in substitution for such lost, destroyed or stolen certificate.

(1) If any Share Purchase Warrant Certificate becomes mutilated or is lost, destroyed or stolen, SMTC Canada, subject to applicable law and to Subsection 2.14(2), will issue, and thereupon the Trustee will certify and deliver, a new Share Purchase Warrant Certificate of like date and tenor as the one mutilated, lost, destroyed or stolen in exchange for and in place of and on surrender and cancellation of such mutilated Share Purchase Warrant Certificate or in lieu of and in substitution for such lost, destroyed or stolen Share Purchase Warrant Certificate and the substituted Share Purchase Warrant Certificate shall be in a form approved by the Trustee and shall entitle the holders to the benefits hereof and rank pari passu in accordance with its terms and with all other Share Purchase Warrants issued hereunder.
