Investigation of Financial Condition. Without in any manner reducing or otherwise mitigating the representations contained herein, Egenix and its legal counsel and accountants shall have the opportunity to meet with legal counsel of Pathogenics and accountants of Pathogenics to discuss the financial condition of Pathogenics. Pathogenics shall make available to Egenix all books and records of Pathogenics.
