Interference and Engineering Study. Before obtaining a building 18 permit, Licensee must pay for the reasonable cost of (i) a radio frequency interference study 19 carried out by an independent and qualified professional licensed RF engineer showing that 20 Licensee’s intended use will not interfere with any existing communications facilities and (ii) a 21 study from a state licensed structural engineer showing that the Structure(s) and/or FTTFs are 22 able to support the Licensee’s Facilities, as defined in Section 3.3 without prejudice to the City’s 23 use of the Structure(s). If the studies find that there is a potential for interference or for 24 prejudice to the Structure(s) and/or FTTFs that cannot be remedied, City may terminate this 25 License immediately and refund the initial License Fee to Licensee.
