The hours of use will be 6:00 a.m. until approximately 7:45 a.m. Monday through Friday beginning no earlier than May 1 and ending no later than August 31 Assigned days and hours are subject to change during the period of this agreement if West Orange activities mandate such change. In the event of a conflict with a Township activity where pool and changing room use is required, the Township shall contact the Senior Aquatics Director of the Montclair Y and notify the Licensee of the unavailability of the premises as soon as the conflict is evident. No alternate arrangements need be made.

The product(s) may be placed on a Local Area Network, Wide Area Network, Intranet, server, internal web site, mainframe, Operations Support System or other electronic computing platform shared or accessible to employees of Licensee. This license shall further include the right to share or make accessible the product(s) to consultants or contractors who are hired to perform services on behalf of Licensee as long as such consultant or contractor is subject to an agreement requiring confidentiality of the product(s), and which limits the use of the product(s) by the consultant or contractor to providing services to Licensee. Licensee's Use. (a) Arena and Exclusive and Non-Exclusive Area Use for League, Games and Practices.
(i) On each League Game Date, from four hours prior to the commencement of the League Game until one hour after the completion of the League Game, subject to Section 3.7. hereof, Licensee and its personnel, guests and invitees (including holders of tickets of admission' to the Arena, holders of press and media credentials and visiting team personnel) shall have the exclusive possession and use of the Arena and the Exclusive Areas and non-exclusive use of the Non-Exclusive Areas for (the purpose of playing the League Game, and the exhibition thereof, live and by radio, television or any other medium. During all periods for which a Team practice or an Other League Event has been scheduled in the Arena in accordance with Section 4, Licensee and its personnel, guests and invitees shall •have the exclusive possession and use of those components of the Arena and the Exclusive Areas and the non-exclusive use of those components of the Non-Exclusive Areas that are necessary for the conduct of such practice or event.
(ii) Licensor shall also provide Licensee with three hours of daily practice time from 9:00 a.m. until 12:00 p.m. including seasonal and playoff practices, and those terms stipulated in Section 4.2 hereof, should any conflict arise in regard to daily practice time in the Arena, then Licensor may substitute, at no cost to Licensee, such daily practice time in the Rink, providing, as much as possible and practicable, either daily practice time pursuant hereto in the Arena or in the Rink.
(iii) Licensor agrees to make the Arena and Exclusive Areas available to Licensee at least four hours prior to any ice Hockey Games.
Licensee's Use. Licensee acknowledges and agrees that all use of the Licensed Trademarks by Licensee shall inure to the benefit of Licensor and hereby assigns any and all right, title or interest in or to the Licensed Trademarks and all the goodwill associated therewith that may accrue to the benefit of, or be acquired by, Licensee as a result of its exercise of the rights and licenses granted pursuant to this Agreement or otherwise. Sales by Licensee of Licensed Equipment in connection with the Licensed Trademarks shall be deemed to have been made by Licensor for purposes of trademark registrations of the Licensed Trademarks and all uses of the Licensed Trademarks by Licensee shall inure to the benefit of Licensor for such purposes.
Licensee's Use. The hosting services are provided for Licensee’s individual business, and Licensee may not transfer any connections, nor resell any of the hosting services to any third party. Rightnow may engage subcontractors to perform the hosting services so long as such subcontractors comply with the terms of this Appendix B.

Licensee shall use the Premises solely for the installation, operation and maintenance, at Licensee’s sole expense, of Licensee’s Telecom Equipment for the purpose of providing communications services in accordance with the Federal Communication Commission (“FCC”) license or licenses held by Licensee for said use (“FCC License”), a copy of which shall be provided to Licensor. Subject to the other terms and conditions hereof, Licensee shall have the right to install, maintain, repair and replace Licensee’s Telecom Equipment. Licensee shall conduct its communication services at the Premises utilizing only the frequency or frequencies, along with details of Licensee’s Antenna Facilities specified on Exhibit 4. Licensee shall not change or add to these frequencies without the prior written consent of Licensor, which consent shall not be unreasonably withheld. No exclusive use of the Property has been granted to Licensee by this Agreement. Licensor shall have the right to approve or disapprove, in Licensor’s sole discretion, any changes or additions to Licensee’s Telecom Equipment in accordance with Paragraph 12 of this Agreement. Except as provided in Paragraph 12, nothing contained in this Agreement shall be interpreted to obligate Licensor to consent to any requested change or addition to Licensee’s Telecom Equipment.
