Common use of Initial use Clause in Contracts

Initial use. 1) For the initial payments set forth in this agreement, the commercial announcements recorded at any one session, may be broadcast either by television stations or by radio stations, but not by both, during a period of thirteen (13) weeks (“initial cycle”) from the date of the first broadcast. If any commercial announcement recorded is used in a second broadcast medium, during the initial thirteen (13) week cycle, each musician designated to that commercial must receive a fee amounting to one hundred percent of the original session fee. Refer to Section for use of commercials on the Internet and ROM. 2) Up to three (3) commercials may be recorded in the original session and they must be broadcast for the first time within months following the session. Seasonal commercials may be recorded and will include advertising messages for Christmas, Valentine’s Day, Easter, Mother’s Day, Father’s Day, Canada Day, Thanksgiving Day and Halloween. For these seasonal commercials the period shall be twelve (12) months. Commercial not broadcast within the time frame of this paragraph are considered dormant.
