Common use of Initial Orders Clause in Contracts

Initial Orders. Concurrent with the execution of this Agreement, CryoLife has submitted to SMI a purchase order as more particularly set forth on Schedule 3.6. SMI agrees that to the extent that any Product noted on that order cannot be sold because of an expiration date, that SMI will assist CryoLife in shipping substitutes for such Product to CryoLife. Additionally, CryoLife agrees to purchase SMI’s current inventory of OrthoClot Product, up to 7,500 units, at a purchase price of [***] U.S. dollars ($[***]) for one gram product and [***] U.S. dollars ($[***]) for three gram product all as further set forth on Schedule 3.6.
