Common use of Initial Maintenance Term Clause in Contracts

Initial Maintenance Term. Provided that TxDOT issues Maintenance NTP1, the Initial Maintenance Term shall commence upon Substantial Completion of the Project (“Initial Maintenance Commencement Date”), and shall expire five years from the Initial Maintenance Commencement Date, unless terminated earlier in accordance with the terms of this Capital Maintenance Agreement.

Provided that In the event TxDOT issues Maintenance NTP1NTP1 in accordance with Section 2.2, the Initial Maintenance Term option shall commence upon Substantial Completion two years after Final Acceptance of the Project to be constructed in accordance with the Development Agreement (the “Initial Maintenance Term Commencement Date”), and shall expire continue for a period of five years from the Initial Maintenance Commencement Dateyears, unless terminated earlier in accordance with the terms of this Capital Maintenance Agreement.
