Initial Classification Clause Samples

The Initial Classification clause defines how certain items, information, or materials are categorized at the outset of an agreement or process. Typically, this clause specifies the criteria or standards used to assign an initial status or level—such as confidential, proprietary, or public—to relevant materials. For example, documents exchanged at the start of a project may be automatically classified as confidential until reviewed. The core function of this clause is to establish a clear baseline for handling and protecting materials from the beginning, thereby reducing ambiguity and ensuring that all parties understand their obligations regarding the initial treatment of such items.

Such initial ranking will be determined in a manner deemed most appropriate by the committee and must adhere to the classifications and criteria specified in subsection “A” above. The Advancement Committee shall be the final arbiter of all initial classifications.
