Ineffective Provisions. If any document incorporated by reference into this agreement, and/or referenced therein, contains a provision (a) allowing for the automatic termination of your license rights or technical support services; (b) allowing for the automatic renewal of services and/or fees; (c) requiring the governing law to be anything other than Federal law, and/or (d) that otherwise violates applicable Federal law, then, such terms shall not apply and shall have no effect. If any document incorporated by reference into this agreement, including additional terms and conditions included and/or referenced therein, contains an indemnification provision, such provision shall not apply as to the United States indemnifying the Publisher or any other party.
Ineffective Provisions. Should individual provisions of this contract, for any reason, found to be or become ineffective, or should a fulfillment discrepancy arise, then notwithstanding this agreement shall remain in full force. A provision that is closest in the scope of the legal possibilities of what the parties intended - or if they had considered the provision would have want- ed - shall replace the ineffective provision or the fulfillment discrepancy, if necessary retrospectively.

If any of the provisions of this Capacity Contract, including any part of the General Terms and Conditions is or becomes ineffective, illegal, invalid, unenforceable, inoperative or void, the effectiveness of the other provisions shall not be affected or impaired thereby and will remain in full force and effect. The Parties undertake to replace the ineffective, illegal, invalid, unenforceable, inoperative or void provision by a new and effective operable provision which approximates to it as closely as possible in economic, technical and/or legal terms.

Ineffective Provisions. 8.1 If any of the provisions of this Frame Capacity Contract, including any part of the GTC is or becomes ineffective, illegal, invalid, unenforceable, inoperative or void, the effectiveness of the other provisions shall not be affected or impaired thereby and will remain in full force and effect. The Parties undertake to replace the ineffective, illegal, invalid, unenforceable, inoperative or void provision by a new and effective operable provision which approximates to it as closely as possible in economic, technical and/or legal terms.

A provision that is closest in the scope of the legal possibilities of what the parties originally intended shall replace the ineffective provision or shall fill the gap, if necessary also retrospectively.

If any of the provisions hereof becomes invalid, unlawful or unenforceable in any way, such fact shall not affect or otherwise infringe the validity, lawfulness or enforceability of the remaining provisions hereof in any way. If any of the provisions hereof becomes invalid (e.g. as a result of a change in generally binding legal regulations), the Contracting Parties commit to replace such invalid portions of this Contract by new provisions that comply with applicable generally binding legal regulations and that as closely as possible approximate the purpose of the Contract assumed by the Contracting Parties.
