Indebtedness Generally. Set forth on Schedule 3.2.8 is a true, complete and accurate (a) list of all loan agreements, promissory notes, letter of credit or surety bond agreement, guarantees, indemnitees or other agreements or instruments of indebtedness to which Susanville is a party or bound (collectively, the “Debt Agreements”), together with the unpaid principal amount owing by Susanville thereunder, and (b) all mortgages, deeds of trust, liens, security interests, pledge agreements and other agreements of encumbrance entered into by Susanville (or to which its assets are bound) as collateral security for the indebtedness created under any Debt Agreement or the indebtedness or obligations or liabilities of any other Person.
