Common use of Inconsistency of Name and Account Number Clause in Contracts

Inconsistency of Name and Account Number. Merchant acknowledges and agrees that, if an Entry describes the Receiver inconsistently by name and account number, payment of the Entry transmitted by TSYS, through its Third-Party Sender where applicable, to the ODFI or from the ODFI to the RDFI may be made by the RDFI (or by the ODFI in the case of an On-Us Entry) on the basis of the account number supplied by Merchant, even if it identifies a person different from the named Receiver, and that Xxxxxxxx's obligation to pay the amount of the Entry is not excused in such circumstances. Without limitation, TSYS, its Third-Party Sender and the ODFI shall be entitled to rely on the routing and transit number provided to TSYS by Merchant, even though the routing and transit number does not correctly identify the financial institution named in the Entry.
