In processing a request for reconsideration. 1. The Employee shall be given the opportunity to contest personally, and in writing, the basis for the negative determination;
2. The Employee shall be given the opportunity to have a Representative of his/her own choosing: and
3. A reasonable amount of time shall be given to both the Employee and the Representative to present the request. When reconsideration by the Agency (OPIC) or appeal to OPM results in a decision favorable to the Employee, the within grade increase shall be effective as of the date it would have been made, had the initial determination been favorable. When the reconsideration or appeal sustains the original unfavorable decision, or the Employee does not request reconsideration, a new determination should be made as soon as the supervisor is satisfied that the Employee has attained an acceptable level of competence, but no later than 52 weeks from the date of the unfavorable determination. A new determination under this section, if favorable to the Employee, shall be effective the first day of the pay period following the new determination.
