Common use of Improvement or Special Assessment District Clause in Contracts

Improvement or Special Assessment District. If at any time during the Term of this Lease any governmental subdivision shall undertake to create a new improvement or special assessment district (including lighting and landscape districts and community facilities districts) the proposed boundaries of which shall include any portion of the Land, Tenant shall be entitled to appear in any proceeding relating thereto and to present its position as to whether the Property should be included or excluded from the proposed improvement or assessment district and as to the degree of benefit to the Property resulting therefrom. Landlord shall promptly advise Tenant in writing of the receipt of any notice or other information relating to the proposed creation of any such improvement or special assessment district, the boundaries of which include any portion of the Land.

If at any time during the Term of this Lease any governmental subdivision with taxing authority shall undertake to create a new an improvement or special assessment district (including lighting and landscape districts and community facilities districts) the proposed boundaries of which shall include any portion of the LandTotal Site, Landlord and Tenant shall each be entitled to appear in any proceeding relating thereto and to present its position their respective positions as to whether the Property Total Site should be included or excluded from the proposed improvement or assessment district and as to the degree of benefit to the Property Total Site resulting therefrom. Landlord or Tenant shall each promptly advise Tenant the other in writing of the receipt of any notice or other information relating to the proposed creation of any such improvement or special assessment district, the boundaries of which include any portion of the LandTotal Site.

Landlord Lessor shall promptly advise Tenant Lessee in writing of the receipt of any notice or other information relating to the proposed creation of any such improvement or special assessment district, the boundaries of which include any portion of the LandProperty.
