Common use of IF YOU ARE A TRUSTEE Clause in Contracts

IF YOU ARE A TRUSTEE. If you are a trustee of any trust, you agree that you are liable under this agreement both personally and as trustee. Unless we agree otherwise in writing, you must not: • stop being trustee of the trust or allow anyone else to be appointed trustee; or • deal with any property of the trust; or • change the terms of the trust; or. • end the trust or do anything which could lead to it being ended before the time stated in the trust deed; or • distribute any capital of the trust; or • distribute any income of the trust if doing so affects your ability to repay the money owing; or • do anything else in connection with the trust which adversely affects your ability to repay the money owing
