Common use of Historical, Scientific, and Archeological Discoveries Clause in Contracts

Historical, Scientific, and Archeological Discoveries. All articles of historical or scientific value, including, but not limited to, coins, fossils, and articles of antiquity, which may be uncovered by Contractor during the progress of the Work shall become Owner’s property. If Contractor establishes that such discoveries have impacted its cost or time of performance, Contractor shall be entitled to an appropriate Change Order, provided that Contractor satisfies the requirements of Section 5.3 and Articles 13 and 19. The notification and, when required, work stoppage described in Section 5.3 are each conditions precedent to Contractor’s entitlement to any increase in the Contract Price or to any extension of the Scheduled Substantial Completion Date.
