HEATING, VENTILATING, AIR CONDITIONING. On Monday through Friday, -------------------------------------- except holidays, from 8:00 a.m. to 6:00 p.m. and on Saturday from 9:00 a.m. to 1:00 p.m. (and at other times for an additional standard hourly charge to be fixed by Landlord, which hourly charge is currently $17.00 per hour), ventilation, air conditioning or heating on such days and hours, when in the reasonable judgment of Landlord it may be required for the comfortable occupancy of the Premises. Tenant agrees to cooperate fully at all times with Landlord, and to abide by all reasonable regulations and requirements which Landlord may prescribe for the proper function and protection of the air conditioning system. Tenant agrees not to connect any apparatus, device, conduit or pipe to the air conditioning system. Tenant further agrees that neither Tenant nor its servants, employees, agents, visitors, licensees or contractors shall at any time enter the mechanical installations or facilities of the Building or the Project or adjust, tamper with, touch or otherwise in any manner affect said installations or facilities. The cost of maintenance and service calls to adjust and regulate the air conditioning system will be charged to Tenant if the need for maintenance work results from either Tenant's adjustment of room thermostats or Tenant's failure to comply with its obligations hereunder. Such work will be charged at hourly rates equal to then-current journeyman's wages for air conditioning mechanics. When heat generating machines, equipment, fixtures or other devices of any nature whatsoever, including by way of illustration but not by way of limitation, computer and other electronic data processing equipment, are used in the Premises by Tenant which affect the temperature otherwise maintained by the air conditioning system, Landlord shall have the right, but not the obligation, after prior written notice to Tenant to install supplementary air conditioning units in the Premises, and the cost thereof, including the commercially reasonable cost of installation and the commercially reasonable cost of maintenance thereof, shall be paid by Tenant to Landlord upon demand by Landlord, which demand shall be accompanied by reasonable notice of the amount owing.

HEATING, VENTILATING, AIR CONDITIONING. On Monday through Friday1. Landlord shall furnish and install heating and cooling unit(s) sized to one (1) ton of HVAC per one hundred fifty (150) square feet of enclosed Premises area. Landlord will provide equipment installed on the roof and within the tenant space, -------------------------------------- except holidaysline set connected to the equipment on the roof per Landlord’s Master Plans. Final connections of the line set, from 8:00 a.m. controls, power, and start up are the responsibility of the Tenant. Upon start up, the HVAC Warranty will be assigned to 6:00 p.m. the Tenant. Tenant shall furnish and on Saturday from 9:00 a.m. install all remaining components of the HVAC system, including but not limited to 1:00 p.m. (ductwork, diffusers, economizers, and thermostats at Tenant’s sole cost and expense.
2. Per locations as specified in Landlord’s master plans, all exhaust systems for the HVAC system applicable to Tenant’s Work and/or equipment shall be furnished and installedby Tenant and at other times for an additional standard hourly charge Tenant's sole cost and expense. This includes connections to be fixed exhaust systems furnished by Landlord. Quantities of exhaust are limited to that which is shown on Landlord’s master plans. Tenant’s kitchen hood exhaust shall be furnished and installed by tenant in chase to roof provided by Landlord. Any exhaust scrubbers required by the local municipality shall be the responsibility of Tenant to furnish, which hourly charge is currently $17.00 per hour)install, ventilation, and maintain at Tenant’s sole costs.
3. Outside air conditioning or heating on such days and hours, when in certain locations shall be supplied by ductwork through a shaft in the reasonable judgment of Landlord it may be required for the comfortable occupancy of the Premisesbuilding and/or side wall louvers. Tenant agrees shall extend through this shaft or connect to cooperate fully at side wall louvers for outside air and shall furnish all times with Landlordcode required items, including but not limited to, ductwork, fans, control dampers, and to abide by all reasonable regulations and requirements which Landlord may prescribe for the proper function and protection of the air conditioning systemfire dampers. Tenant agrees not to connect any apparatus, device, conduit or pipe to the air conditioning system.
