Heat, Ventilation and Air Conditioning. (a) Landlord shall provide heat and air-conditioning to the Premises on Business Days from 7:00 A.M. to 8:00 P.M., and Saturdays from 8:00 A.M. to 4:00 P.M., when required in Landlord’s reasonable judgment for the comfortable use and occupancy of the Premises (provided, in no event shall the Premises be deemed comfortable for use and occupancy if the temperature of the Premises is colder than 66 degrees in the winter or warmer than 76 degrees in the summer), through use of the Building standard heating, ventilating and air conditioning system (the “Building Heating HVAC System”).
(b) Notwithstanding anything in this Section 10.2 to the contrary, Landlord shall not be responsible if the normal operation of the Building Heating HVAC System shall fail to provide heat or air conditioning at reasonable temperatures uniformly to all interior portions of the Premises. Tenant at all times shall cooperate fully with Landlord and shall abide by the regulations and requirements which Landlord may prescribe for the proper functioning and protection of the Building Heating HVAC System.
(c) Landlord shall not be required to furnish heat and air-conditioning during periods other than the hours and days set forth in this Section 10.2 for the furnishing and distributing of such services (“Overtime Periods”), unless Landlord has received advance notice from Tenant requesting such service not less than twenty-four (24) hours prior to the time when such service shall be required. Accordingly, if Landlord shall furnish heat or air-conditioning to the Premises at the request of Tenant during Overtime Periods, Tenant shall pay Landlord, as Additional Rent, on a monthly basis, for such services at the standard rate then fixed by Landlord for the Building (which amount, as of the Effective Date, is $50.00 per hour, subject to adjustment by Landlord from time to time based on Landlord’s customary rates). Failure by Landlord to furnish or distribute heat, air-conditioning or any other services during Overtime Periods shall not constitute an actual or constructive eviction, in whole or in part, or, except as provided in Section 10.6(b) hereof, entitle Tenant to any abatement or diminution of Fixed Rent or Additional Rent, or relieve Tenant from any of its obligations under this Lease, or impose any liability upon Landlord or its agents by reason of inconvenience or annoyance to Tenant, or injury to or interruption of Tenant’s business or otherwise.
Heat, Ventilation and Air Conditioning. 1. Common chillers will be provided to cater to air conditioned office area load @ 275 sft / TR. Chilled water pipes will be connected to the AHU’s.
2. Dedicated AHU’s will be provided whose ducts will be connected to the heat recovery wheels.
3. Common fresh air ducting shall be provided in the shafts with collars towards the toilets.
4. Installing, maintenance and necessary replacements calibrated BTU meters with necessary valve packages.

2. Infrastructure improvements to meet Tenant’s air-con enhancement needs for the lab area.
3. Installation of indoor and outdoor units of package/ split/ ductable AC’s with necessary platform in ODU shaft and connecting their drain at respective floor.

Landlord shall provide to the Premises through the existing Building system, when and as required for the comfortable occupancy of the Premises (as reasonably determined by Landlord), heat, ventilation and air conditioning, on Business Days during Business Hours. Landlord makes no representation and shall have no obligation or liability with respect to the performance of the Building system by reason of (a) the use of the Premises, or any part thereof, in a manner exceeding the design criteria of the system, (b) the arrangement of any partitioning or the ceiling distribution system in the Premises which interferes with normal operation of the system, (c) the use of any machines or equipment in the Premises, except for ordinary office machines which do not produce excess heat, (d) Tenant’s failure to comply with this lease which affects the performance of the system, (e) Tenant’s Work, (f) any other act of Tenant or Tenant’s employees or contractors, or (g) any Law.
Heat, Ventilation and Air Conditioning. Landlord shall have no obligation to provide heat, ventilation, air-conditioning, or other services to the Premises unless otherwise specifically set forth in this Lease.

Tenant shall, at Tenant's sole cost and expense, subject to any guaranties or warranties made by Ground Lessor pursuant to the Guarantee, maintain and operate the heating, ventilating and air-conditioning systems ("HVAC") serving the Demised Premises, and shall furnish HVAC in the Demised Premises as Tenant may require.
Heat, Ventilation and Air Conditioning. 19.01 Tenant shall maintain and operate the heating, ventilating and air-conditioning systems (“HVAC”) serving the Demised Premises. The temperature maintained in the Demised Premises shall at all times be within the limits prescribed by the Legal Requirements.
19.02 Use of the Demised Premises, or any part thereof, in a manner exceeding the HVAC design conditions (including occupancy and connected electrical load), or rearrangement of partitioning which interferes with normal operation of the HVAC in the Demised Premises, or the use of computer or data processing or storage machines or other machine, or equipment, may require changes in the HVAC systems servicing the Demised Premises, in order to provide comfortable occupancy. Such changes, so occasioned, shall be made by Tenant, at its expense, as alterations in accordance with the provisions of Article 15, but only to the extent permitted and upon the conditions set forth in Article 15.

Landlord shall provide to the Premises through the existing Building Systems, for the comfortable occupancy of the Premises (in accordance with the Building Standard and Building Systems operational sequences as reasonably determined by Landlord), heat, ventilation and air conditioning. Landlord makes no representation and shall have no obligation or liability with respect to the performance or nonperformance of the Building Systems by reason of (a) the use of the Premises, or any part thereof, in a manner exceeding the design criteria of the Building Systems, (b) the arrangement of any partitioning or the ceiling distribution system in the Premises which interferes with normal operation of the Building Systems, (c) the use of machines or equipment in the Premises, except for ordinary office machines which do not produce excess heat, (d) Tenant’s failure to comply with this Lease which affects the performance of the Building Systems, (e) Tenant’s Work, (f) any other act of Tenant or Tenant’s employees or contractors, or (g) any Law. Landlord represents and warrants that as of the Commencement Date the Building Systems are in a proper working condition and can accommodate (i) the operation of the MEN Business in substantially the same manner as conducted in the Premises by Landlord immediately prior to the Commencement Date (operating primarily during the hours of 8am to 6pm, Monday to Friday) including up to [*] square feet of the Rentable Area of the Premises for laboratory uses and, (ii) a population density in the Premises of [*] of Rentable Area of the Premises for the purposes of carrying out the Permitted Uses.
