Common use of Hazardous Substances Carriers Clause in Contracts

Hazardous Substances Carriers. All Hazardous Materials generated at any and all property of any Loan Party have been treated, transported, stored and disposed of in accordance with all Environmental Laws applicable to them, except to the extent the failure to have such Hazardous Materials transported, treated, stored or disposed of by such carriers could not reasonably be expected to result in a Material Adverse Effect, and to each Loan Party’s knowledge after due inquiry, at treatment, storage and disposal facilities maintaining valid Environmental Permits, which carriers and facilities have been and are operating in compliance with such Environmental Permits, except to the extent the failure to have such Hazardous Materials treated, transported, stored or disposed of at such facilities, or the failure of such carriers or facilities to so operate, could not reasonably be expected to result in a Material Adverse Effect.
