Common use of Hazardous Substances Carriers Clause in Contracts

Hazardous Substances Carriers. All hazardous substances or solid waste generated at any and all property of the Borrower or any of its Subsidiaries have in the past been transported, treated, and disposed of only by carriers maintaining valid permits under any Environmental Law and only at treatment, storage, and disposal facilities maintaining valid permits under any Environmental Law, which carriers and facilities have been and are operating in compliance with such permits which could reasonably be expected to result in remedial obligations assuming disclosure to the applicable Governmental Authority of all relevant facts, conditions, and circumstances, if any, pertaining to the relevant property.

Hazardous Substances Carriers. All hazardous substances or solid waste generated at any and all property of the Borrower or any of its Subsidiaries Company have in the past been transported, treated, and disposed of only by carriers maintaining valid permits under any Environmental Law Law, and only at treatment, storage, and disposal facilities maintaining valid permits under any Environmental Law, which carriers and facilities have been and are operating in compliance with such permits, where the failure to maintain and comply with such permits which could reasonably be expected to result in remedial obligations having a Material Adverse Effect assuming disclosure to the applicable Governmental Authority of all relevant facts, conditions, and circumstances, if any, pertaining to the relevant property.
