Hawking Clause Samples
The "Hawking" clause typically refers to a provision that restricts or regulates the ability of a party to actively solicit or market a product or service, often in the context of financial instruments or investment funds. In practice, this clause may prohibit fund managers or agents from directly approaching potential investors or clients to offer participation in a fund, unless certain regulatory or contractual conditions are met. The core function of the Hawking clause is to ensure compliance with legal and regulatory requirements regarding solicitation, thereby reducing the risk of unauthorized or improper marketing activities.
