Hardware Components. SPECIFICATION The hardware components delivered hereunder will conform to the detailed specifications of each component as described in specifications and/or publications provided by the Contractor, including but not limited to, physical characteristics, operating characteristics, space requirements, power requirements and maintenance. Hardware manuals shall be provided to describe the functions, characteristics and operating capabilities that may be expected of the Contractor's System. PERSONS SIGNING THIS AGREEMENT ARE AUTHORIZED REPRESENTATIVES OF EACH PARTY TO THIS AGREEMENT AND ACKNOWLEDGE THAT EACH PARTY AGREES TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.

Hardware Components. The Vendor shall ensure that the servers, desktops, peripherals and other equipment provisioned by the Vendor shall at all times support the proposed application systems and meet the functional and technical specifications as more particularly specified under the Contract.

  • Consumables During the design phase, Purchaser may participate in the selection of suppliers of consumables of the Supplier. In such case, the choice regarding the final selection of the said suppliers shall be mutually agreed between the Parties. Two suppliers shall be identified and selected for each type of consumables.

  • Tooling Unless otherwise specified in this Agreement, all tooling and/or all other articles required for the performance hereof shall be furnished by Seller, maintained in good condition and replaced when necessary at Seller's expense. If NETAPP agrees to pay Seller for special tooling or other items either separately or as a stated part of the unit price of Goods purchased herein, title to same shall be and remain in NETAPP upon payment therefore.
