Common use of Guaranty of Performance Clause in Contracts

Guaranty of Performance. Guarantor additionally hereby unconditionally guarantees to Lenders the timely performance of all other obligations of Borrower under all of the Loan Documents. Without limiting the foregoing, Guarantor confirms all representations and warranties, and agrees to perform and comply with all covenants and agreements, expressly made applicable to Guarantor under the Credit Agreement.

Guaranty of Performance. Guarantor additionally hereby unconditionally guarantees to Lenders the timely full and faithful performance by Borrowers of all other of Borrowers’ obligations of Borrower to Lender arising under the Term Note and, to the extent pertaining to the indebtedness arising under the Term Note, the Loan Agreement. Guarantor shall assume responsibility for and shall fully perform all of the Loan Documents. Without limiting the foregoing, Guarantor confirms all representations and warranties, and agrees such obligations promptly on receiving written notice from Lender that Borrowers have failed to perform and comply with all covenants and agreements, expressly made applicable to Guarantor under the Credit Agreementany such obligations.
