Common use of Guaranty of Performance Clause in Contracts

Guaranty of Performance. The Guarantors also jointly and severally guarantee the full, prompt and unconditional performance of all obligations and agreements of every kind owed or hereafter to be owed by the Debtor and the other Guarantors to the Agent or the Banks. Every provision for the benefit of the Agent or the Banks contained in this Guaranty shall apply to the guaranty of performance given in this Paragraph 8.

Every provision for the benefit of the Lenders and Collateral Agent or the Banks contained in this Guaranty shall apply to the guaranty of performance given in this Paragraph 8paragraph.

Every provision for the benefit of the Agent or the Banks and Lenders contained in this Guaranty shall apply to the guaranty of performance given in this Paragraph 8Section 9.

The Guarantors Each Guarantor also jointly and severally guarantee guarantees the full, prompt and unconditional performance of all obligations and agreements of every kind owed or hereafter to be owed by the Debtor Company to Holders under the Exchange Agreement, the Warrants and the other Guarantors to the Agent or the BanksNotes. Every provision for the benefit of the Agent or the Banks Holders contained in this Guaranty shall apply to the guaranty of performance given in this Paragraph 8paragraph.

The Guarantors Guarantor also jointly and severally guarantee guaranties the full, prompt and unconditional performance of all obligations and agreements of every kind owed or hereafter to be owed by the Debtor Company to the Buyers and the Collateral Agent under the Purchase Agreement, the Warrants, the Security Documents, the Notes and the other Guarantors to the Agent or the BanksTransaction Documents. Every provision for the benefit of the Agent or the Banks and Lenders contained in this Guaranty shall apply to the guaranty of performance given in this Paragraph 8Section 9.

Lenders Every provision for the benefit of the Agent or the Banks Lenders contained in this Guaranty shall apply to the guaranty of performance given in this Paragraph 8.paragraph. Without limiting the foregoing, the Guarantor shall cause each other Loan Party to perform all obligations and agreements of such Loan Party contained in the Credit Agreement or any other Loan Document in accordance with the terms thereof

Guaranty of Performance. The Guarantors Each Guarantor also jointly and severally guarantee guaranties the full, prompt and unconditional performance of all obligations and agreements of every kind owed or hereafter to be owed by the Debtor Borrower to Lenders and Collateral Agent under the Purchase Agreement, Security Documents, the Warrants, the Registration Rights Agreement and the other Guarantors to the Agent or the BanksNotes. Every provision for the benefit of the Lenders and Collateral Agent or the Banks contained in this Guaranty shall apply to the guaranty of performance given in this Paragraph 8paragraph.
