Common use of Grant of Sublicense Clause in Contracts

Grant of Sublicense. Subject to the terms and conditions of this Agreement, Adviser hereby grants to the Trust a non-transferable sublicense to use the Index (and associated data and information) listed on Exhibit A in the manner set forth in, and subject to the terms of, the License Agreement.

Grant of Sublicense. Subject to the terms and conditions of this Agreement, Adviser hereby grants to the Trust a non-exclusive and non-transferable sublicense to use and refer to the Index Indexes (and associated data and information) listed on Exhibit A and Marks and any other rights that may be sublicensed under the License Agreements in the manner set forth in, and subject to the terms of, the License AgreementAgreements, in connection with the creation, issuance, management, offering, sale, marketing and promotion of the Funds.

Subject to the terms and conditions of this Agreement, Adviser hereby grants to the Trust a non-transferable sublicense to use the Index Indexes (and all associated Index data and informationmaterials) listed on Exhibit A in the manner set forth in, and subject to the terms of, the License Agreement, including without limitation the restrictions of the License Agreement.

Subject to the terms and conditions of this Agreement, Adviser hereby grants to the Trust a non-transferable sublicense to use the Index (and associated data and information) listed on Exhibit A in the manner set forth in, and subject to the terms of, the License Agreement., a copy of which is appended to this Agreement as Exhibit B.

Subject to the terms and conditions of this Agreement, Adviser Index Provider hereby grants to the Trust a non-transferable sublicense to use the Index (and associated data and information) listed on Exhibit A in the manner set forth in, and subject to the terms of, the License Agreement.

Subject to the terms and conditions of this Agreement, Adviser hereby grants to the Trust a non-exclusive and non-transferable sublicense to use and refer to the Index Indexes (and associated data and information) listed on Exhibit A and Marks and any other rights that may be sublicensed under the License Agreement in the manner set forth in, and subject to the terms of, the License Agreement, in connection with the creation, issuance, management, offering, sale, marketing and promotion of the Index Funds.

Subject to the terms and conditions of this Agreement, Adviser hereby grants to the Trust a non-transferable sublicense to use the Index Indexes (and all associated Index data and informationmaterials) listed on Exhibit A in the manner set forth in, and subject to the terms of, the License Agreement, including without limitation the restrictions of the License Agreement. Each Index that is as subject of this sublicense is set forth on Exhibit A, which schedule may be updated from time to time by mutual agreement of the parties.
