Common use of Government Regulation Clause in Contracts

Government Regulation. Borrower shall not (a) be or become subject, at any time, to any law, regulation, or list of any government agency (including, without limitation, the U.S. Office of Foreign Asset Control list) that prohibits or limits Lender from making any advance or extension of credit to Borrower or from otherwise conducting business with Borrower or (b) fail to provide documentary and other evidence of Borrower’s identity as may be requested by Lender at any time to enable Lender to verify Borrower’s identity or to comply with any applicable law or regulation, including, without limitation, Section 326 of the USA Patriot Act of 2001, 31 U.S.C. Section 5318.

Government Regulation. Borrower shall not (a) be or become subject, subject at any time, time to any law, regulation, or list of any government agency (including, without limitation, the U.S. Office of Foreign Asset Control list) that prohibits or limits Lender from making any advance or extension of credit to Borrower or from otherwise conducting business with Borrower Borrower, or (b) fail to provide documentary and other evidence of Borrower’s 's identity as may be requested by Lender at any time to enable Lender to verify Borrower’s 's identity or to comply with any applicable law or regulation, including, without limitation, Section 326 of the USA Patriot Act of 2001, 31 U.S.C. Section 5318.

Borrower shall not (a) be or become subject, subject at any time, time to any law, regulation, or list of any government agency Governmental Authority (including, without limitation, the U.S. Office of Foreign Asset Control list) that prohibits or limits Lender the Lenders from making any advance or extension of credit to Borrower or from otherwise conducting business with Borrower Borrower, or (b) fail to provide documentary and other evidence of Borrower’s identity as may be requested by any Lender at any time to enable such Lender to verify Borrower’s identity or to comply with any applicable law or regulation, including, without limitation, Section section 326 of the USA Patriot Act of 2001, 31 U.S.C. Section section 5318.

Section 5318.

Government Regulation. Borrower Borrowers shall not (a1) be or become subject, subject at any time, time to any law, regulation, or list of any government agency (including, without limitation, the U.S. Office of Foreign Asset Control list) that prohibits or limits Lender Lenders from making any loan advance or extension of credit to Borrower Borrowers or from otherwise conducting business with Borrower Borrowers, or (b2) fail to provide documentary and other evidence of Borrower’s Borrowers' identity as may be requested by Lender Lenders at any time to enable Lender Lenders to verify Borrower’s Borrowers' identity or to comply with any applicable law or regulation, including, including without limitation, Section 326 of the USA Patriot Act of 2001, 31 U.S.C. Section 5318.

Government Regulation. Neither Borrower shall not will: (ai) be or become subject, subject at any time, time to any law, regulation, applicable law or list of any government agency (including, without limitation, the U.S. Office of Foreign Asset Control listOFAC) that prohibits or limits any Lender from making any advance or extension of credit to such Borrower or from otherwise conducting business with Borrower such Borrower, or (bii) fail to provide documentary and other evidence of such Borrower’s identity as may be requested by any Lender or the Issuing Bank at any time to enable such Lender or the Issuing Bank to verify Borrower’s its identity or to comply with any applicable law or regulationlaw, including, without limitation, Section 326 of the USA Patriot Act of 2001, 31 U.S.C. Section 5318.

Government Regulation. The Borrower shall not (a) be or become subject, subject at any time, time to any law, regulation, or list of any government agency (including, without limitation, the U.S. Office of Foreign Asset Control list) that prohibits or limits Lender the Bank from making any advance or extension of credit to the Borrower or from otherwise conducting business with Borrower the Borrower, or (b) fail to provide documentary and other evidence of the Borrower’s identity as may be requested by Lender the Bank at any time to enable Lender the Bank to verify the Borrower’s identity or to comply with any applicable law or regulation, including, without limitation, Section 326 of the USA Patriot Act of 2001, 31 U.S.C. Section 5318.

U.S.C Section 5318.

Section 5318. (f) Section 7.01 of the Agreement is hereby amended to read as follows:

Government Regulation. No Borrower shall not (a) be or become subject, subject at any time, time to any law, regulation, or list of any government agency (including, without limitation, the U.S. Office of Foreign Asset Control list) that prohibits or limits Lender from making any advance or extension of credit to any Borrower or from otherwise conducting business with Borrower any Borrower, or (b) fail to provide documentary and other evidence of each Borrower’s identity as may be and when requested by Lender at any time to enable Lender to verify each Borrower’s identity or to comply with any applicable law or regulation, including, without limitation, Section 326 of the USA Patriot Act of 2001, 31 U.S.C. Borrower The Borrowers shall not (ai) be or become subject, subject at any time, time to any law, regulation, or list of any government agency (including, without limitation, the U.S. Office of Foreign Asset Control list) that prohibits or limits the Lender from making any advance or extension of credit to any Borrower or from otherwise conducting business with Borrower the Borrowers, or (bii) fail to provide documentary and other evidence of Borrower’s the identity of any Borrower as may be requested by the Lender at any time to enable the Lender to verify Borrower’s the identity of any Borrower or to comply with any applicable law or regulation, including, without limitation, Section 326 of the USA Patriot Act of 2001, 31 U.S.C. Section 5318.

Section 5318.

Government Regulation. The Borrower shall not (a) be or become subject, subject at any time, time to any law, regulation, or list of any government agency (including, without limitation, the U.S. Office of Foreign Asset Control list) that prohibits or limits the Lender from making any advance or extension of credit to the Borrower or from otherwise conducting business with Borrower the Borrower, or (b) fail to provide documentary and or other evidence of Borrower’s identity as may be requested by the Lender at any time to enable the Lender to verify the Borrower’s identity or to comply with any applicable law or regulation, including, without limitation, Section 326 of the USA Patriot Act of 2001, 31 U.S.C. Section 5318.
