Golden Eagle Clause Samples

Golden Eagle. Although the list of Covered Species includes the golden eagle, which is a Fully Protected Species, the Permits do not authorize Take of this species. CDFG acknowledges and agrees that if the avoidance measures set forth in the Conservation Strategy, including but not limited to Conservation Measure 1.11, are complied with, the Covered Activities are not likely to result in Take of golden eagles. If CDFG determines that such measures are not adequate to prevent Take of golden eagles, CDFG shall notify the Implementing Entity and other affected Permittees in writing of its determination, and propose new, additional or different conservation measures designed to avoid Take of these species. The affected Permittees shall implement the measures proposed by CDFG, or other measures mutually agreed to by the Parties, to avoid Take of golden eagles.

Golden Eagle. The golden eagle is a fully protected species. CDFW is not permitted to authorize any take of this species. Permittee shall have a Designated Biologist conduct a visual survey for golden eagle within the work area and adjacent 500-foot buffer zone prior to the start of work. Survey results, including negative findings, analysis, recommendations, and field notes shall be submitted to CDFW prior to the start of work. If golden eagle are found, work shall halt until the species has left the project site and is determined to be out of harm’s way.

Golden Eagle. Convey, sell, loan, lease, license, assign or otherwise transfer any assets to Golden Eagle except for any Permitted Intercompany Advances or pursuant to the GEL Administrative Services Agreement in accordance with its terms.
