FULLY BARGAINED FOR PROVISIONS Sample Clauses

The "Fully Bargained For Provisions" clause establishes that all terms and conditions within the agreement have been actively negotiated and mutually agreed upon by the parties. In practice, this means that each party acknowledges they had the opportunity to review, discuss, and influence the contract's language, rather than passively accepting standard terms. This clause helps prevent later claims that certain provisions were unfairly imposed or not understood, thereby ensuring that the contract reflects a true meeting of the minds and reducing the risk of disputes over enforceability.
