Fresh Start After First Offense Clause Samples
The 'Fresh Start After First Offense' clause provides individuals or parties with an opportunity to move forward without lasting penalties after committing a first, typically minor, violation. In practice, this clause may allow for the removal of disciplinary records, the resetting of contractual obligations, or the waiving of certain penalties if the party demonstrates compliance or improvement following the initial infraction. Its core function is to encourage rehabilitation and good behavior by ensuring that a single mistake does not result in disproportionate long-term consequences.
Fresh Start After First Offense. If after a first offense, the employee remains drug-free for a period of three (3) years from the date of the first offense, the employee shall be entitled to the rescission of the first offense for the purposes of applying the reinstatement provisions set forth in Section 2 of Article VI of this Master Contract. If the employee commits a second offense before the employee has remained drug-free for three (3) years after the first offense, the employee is not entitled to have the first offense rescinded. An employee is entitled to only one (1) rescission.
