FPL Responsibilities. FPL agrees that it will contribute to Recipient the amounts, labor and/or equipment as set forth on Exhibit A hereto, which is hereby incorporated by reference into this Agreement (“Contribution”) to be used by Recipient solely for its charitable purposes. The Contribution is provided “as is” without warranty of any kind, express or implied, provided that Recipient may be entitled to equipment manufacturer warranties that pass through to Recipient as end-user of applicable equipment.
