FORCE MAJEURE AND FAILURE IN THE PERFORMANCE. 5.1 If the Contractor cannot perform his obligations towards us (any further) due to force majeure, we shall have the right to cancel the agreement in writing in full or in part, without any judicial intervention being required, also in respect of any already delivered parts. If and in so far as we cannot return that what has already been delivered, a reasonable compensation shall be paid. For the rest we shall not be held to pay any damages.
