Common use of Fleet and Affiliates Clause in Contracts

Fleet and Affiliates. With respect to its commitment hereunder to make Loans, Fleet shall have the same rights and powers under this Agreement and the other Loan Documents as any other Lender and may exercise the same as though it were not Agent; and the terms “Lender,” “Lenders” or “Majority Lenders” shall, unless otherwise expressly indicated, include Fleet in its individual capacity as a Lender. Fleet and its Affiliates may lend money to, and generally engage in any kind of business with, any Co-Borrower, and any Person who may do business with or own Securities of any Co-Borrower all as if Fleet were not Agent and without any duty to account therefor to any other Lender.

Fleet and its Affiliates may lend money to, and generally engage in any kind of business with, Borrower or any Co-Borrower, of its Subsidiaries and any Person who may do business with or own Securities of Borrower or any Co-Borrower such Subsidiary, all as if Fleet were not Agent and without any duty to account therefor to any other LenderLenders.
