Common use of First Amendment Clause in Contracts

First Amendment. The Administrative Agent or the Special Counsel (defined below) shall have received from each Borrower and Lenders constituting the Required Lenders a counterpart of this First Amendment signed on behalf of such party.

First Amendment. The Administrative Agent (or the Special Counsel (defined belowCounsel) shall have received from each the Borrower and Lenders constituting the Required Lenders either (i) a counterpart of this First Amendment signed on behalf of such partyparty or (ii) written evidence satisfactory to the Administrative Agent (which may include telecopy or email transmission of a signed signature page of this First Amendment) that such party has signed a counterpart of this First Amendment.
