Final closure. Closure devices must be constructed to prevent motorized vehicular access through, over or around the device.
Final closure. In the event that ▇▇▇▇▇ proposes a Closure at a time ------------- when ▇▇▇▇▇ no longer operates another Brewery *, but does operate another Brewery, ▇▇▇▇▇ shall: (i) provide written notice to Boston Beer (the "Final Closure Notice") of ▇▇▇▇▇'▇ intent to close the current location; and (ii) offer replacement production at any other brewery owned or operated by ▇▇▇▇▇ during the Final Closure Period, which is defined as the longest of * or * after the date of the actual Closure of the Closed Brewery or through *, such production to be provided by ▇▇▇▇▇ in a manner which is economically equivalent to the then economic arrangements for production of Beer Products at the Brewery then subject to Closure (i.e., ▇▇▇▇▇ shall pay any capital or Incremental Costs, including any increase in freight costs to Boston Beer associated with ▇▇▇▇▇ continuing to supply Boston Beer with Beer Products during the Final Closure Period, over and above those amounts already being paid by Boston Beer prior to and as of the date of the Final Closure Notice), and in a manner that, in the reasonable judgement of Boston Beer, provides the same level of quality, taste and service as was enjoyed by Boston Beer at the Closed Brewery; provided that if Boston Beer accepts such replacement production for periods beyond the Final Closure Period, Boston Beer shall pay any Incremental Costs (defined below) and the brewery at which such replacement production shall occur shall then be deemed to be an "Allowed Location" * If ▇▇▇▇▇ proceeds with the actions contemplated by this subsection (b), ▇▇▇▇▇ would have the right to move the production of Boston Beer's Beer Products from the Initial Location subject to Closure to any other ▇▇▇▇▇ location approved by Boston Beer, such approval not to be unreasonably withheld or delayed, provided, however, that there shall be no disruption in the supply of Beer Products to Boston Beer during the Final Closure Period.
Final closure. Processing of low grade ore is expected to be completed in 2040 at which time Stage 2 — Final Closure will occur. Stage 2 will involve removal and decommissioning of plant site buildings, structure and infrastructure and transfer of assets to the local community and/or regulators as required. Closure activities will include remediation and revegetation of the decommissioned areas and removal and disposal of the Kapit pit c▇▇▇▇▇ dam embankment and Harbour Base. Unwanted buildings in the town site will be demolished with the remaining buildings transferred over time to the local community and/or regulators. Kapit Village will be re-established. The closed Stage 2 condition is illustrated on Figure A.5.4. Major capital works are expected to be completed during 2040 and 2041.
