FERC Application. The documents pursuant to which application for a certificate(s) of public convenience and necessity is made to the FERC by the Company for authority to construct, own and operate the Facilities and to receive, store and deliver natural gas by means of the Facilities (not including any Modifications). The FERC Application shall seek authority to operate the facilities in accordance with the FERC's "open access" regulations and the provisions of Order No. 636 (including the capacity releases provisions).

FERC Application. In instances where an application for a FERC Certificate is required for the Construction Capital Opportunity to be developed and the Board has approved the commitment to construct the Construction Capital Opportunity in accordance with Section 5.8.3 above, then the Board shall cause an application for a FERC Certificate to be prepared and shall submit it to the Members for their review and comment. Within twenty (20) days following the submission of an application for a FERC Certificate to the Members, the Board shall file such FERC Certificate application (as the same may have been revised in connection with the Members' comments, if any) with the FERC.

  • Consistent Application The Employer agrees that management rights will not be exercised in a manner inconsistent with the express provisions of this Agreement.

  • General Application The rules set forth below in this Article VI shall apply for the purposes of determining each Member’s allocable share of the items of income, gain, loss and expense of the Company comprising Net Income or Net Loss for each Fiscal Year, determining special allocations of other items of income, gain, loss and expense, and adjusting the balance of each Member’s Capital Account to reflect the aforementioned general and special allocations. For each Fiscal Year, the special allocations in Section 6.03 hereof shall be made immediately prior to the general allocations of Section 6.02 hereof.

  • Provisional Application Upon signature of this Compact, and until this Compact has entered into force in accordance with Section 7.3, the Parties will provisionally apply the terms of this Compact; provided that, no MCC Funding, other than Compact Implementation Funding, will be made available or disbursed before this Compact enters into force.
