Fair Dealing Clause. Tenant does not have any rights to expand within the Building, other than the First Right of Refusal granted in Section 40(e) above, however, if Tenant wishes to expand and there is additional space within the Building available Landlord will consider a request by Tenant to lease additional space. Such request shall at all times be secondary to any First Right of Refusal action, as defined above, or any First Right of Refusal or expansion right held by any other tenant in the Building. Additionally, any space under negotiation with Tenant on the second floor of the Building shall be subject to the prior right of taking by a third party.
