Failed Installation Clause Samples

The Failed Installation clause defines the procedures and consequences that apply if an installation process does not succeed as intended. Typically, this clause outlines the responsibilities of the parties involved, such as the obligation to remedy the failure, timelines for corrective action, and potential remedies like refunds or replacement services. Its core practical function is to allocate risk and provide a clear framework for resolving issues arising from unsuccessful installations, thereby minimizing disputes and ensuring accountability.
Failed Installation. For reasons including, but not limited to, external or internal building factors, line of sight or unique atmospheric conditions, Rogers may be unable to install the Services at your Site in a manner that is consistent with the expected service experience described in these terms. In addition, Rogers has established minimum performance thresholds (which are subject to change at any time at Rogers’ sole discretion) for the Services that must be met as measured by the installation technician at the completion of an installation. If, after reasonable efforts by Rogers the minimum performance thresholds are not met, the delivery of the Services will be considered a failed installation and you will be released from any obligation to purchase, and Rogers will be released from any obligation to deliver the Services at such Site.
Failed Installation. For reasons including, but not limited to, external or internal building factors, line of sight or unique atmospheric conditions, Rogers may be unable to install the LTE Fixed Wireless Access Services at the Customer’s Site in a manner that is consistent with the expected service experience described in this Product Schedule. If, after reasonable efforts by both Rogers and Customer, this situation occurs, the delivery of the LTE Fixed Wireless Access Services will be considered a failed installation and the Customer will be released from any obligation to purchase, and Rogers will be release from any obligation to deliver, the LTE Fixed Wireless Access Services at such Site, without any liability.
Failed Installation. For reasons including, but not limited to, external or internal building factors, line of sight or unique atmospheric conditions, you or Rogers may be unable to install the Services at the Site in a manner that is consistent with the expected service experience described in these terms. If, after reasonable efforts by both of us, this situation occurs, the delivery of the Services will be considered a failed installation and you will be released from any obligation to purchase, and Rogers will be released from any obligation to deliver, the Services at such Site, without any liability other than your obligation to return the Rogers Equipment pursuant to the terms and conditions of the Agreement.
Failed Installation. The Licensor recognizes that the Customer may fail to properly install the Software Product. Therfore once the Fee is paid the Licensor shall allow the Customer to reasonably repeat the installation process until such time that the Software Product is successfully installed and enabled. In the event the Software Product cannot be successfully installed or enabled, the Licensor may provide the Customer with an electronic copy of the Software Product via other means or refund the Fee.
