Common use of Facility Locations Clause in Contracts

Facility Locations. 4.2.1 Technical Feasibility: CINGULAR may interconnect with NEPTC's network at a technically feasible point within NEPTC’s network as mutually agreed upon by the Parties. The Parties acknowledge for purposes of this requirement that the location(s) will be NEPTC’s host end office switch for the delivery of traffic between the Parties. 4.2.2 The Parties acknowledge that the terms and conditions specified in this Agreement do not apply to the provision of services or facilities by NEPTC in those areas where NEPTC is not the Incumbent LEC. 4.2.3 Each Party will provide the services in this Agreement to the other Party at a standard at least equal in quality and performance to that which the Party provides itself and others. Either Party may request, and the other Party will provide, to the extent technically feasible, services that are superior or higher in quality than the providing Party provides to itself, provided, however, that such services shall be considered special requests, and will be handled on a case-by-case basis.
