EXW. The acronym for the delivery term Ex works (named place of delivery) consistent with the use of EXW in Incoterms® 2010, which for purposes of this Agreement means that Product will be made available for pick up by Athenex at Ingenus’ Lugano Switzerland facility. This is where the risk and title transfer to the Product is deemed to occur.
EXW. 2.1.1. Delivery Date Delivery Date shall mean the moment of the receipt of the Seller’s notice to the Buyer, within the agreed shipment period(s), that the Goods are ready for loading.
EXW. In the event that the buyer picks the product up directly from one or more resource points, it agrees to have its transporter respect the provisions of applicable regulations and, in particular, the provisions falling within the safety protocol and any other provisions which may be included in the internal rules in effect at the loading establishment. The buyer declares that it is fully familiar with all these applicable rules. In addition, the transfer of risks and liability takes place at the time the product passes from the loading arm of the storage site of the resource point into the tank presented by the buyer.
