Delivery Conditions. (a) The Delivery Conditions are as follows:
Delivery Conditions. The Buyer’s obligation to purchase the Aircraft is conditional upon, amongst other things, the Aircraft complying on the Delivery Date with the Delivery Conditions set out in Schedule 9.
Delivery Conditions. 6.1 The Software Product is delivered in the form of temporary licenses which will be converted into permanent licenses upon full payment of the sums owed by the Buyer to the Seller.
Delivery Conditions. (I) After the first installment of the house price is paid up pursuant to the provisions of this Contract, the Seller shall deliver the Commercial House to the Buyer before March 16, 2009. The property management fee shall be computed from April 1, 2009.
Delivery Conditions. The Aircraft will be delivered "AS IS, WHERE IS" at the Delivery Location and will conform to the conditions outlined in this Schedule 4. The actual condition of the Aircraft at Delivery will be documented on the Acceptance Certificate as noted in Schedule 5 of the Aircraft Sublease Agreement.
Delivery Conditions. Supplier will comply with all terms and conditions for delivery set forth in Attachment 5 (Logistics) to the extent agreed upon by the Parties. Unless expressly agreed otherwise in writing, Supplier will deliver at its cost all Products to the Customer address where the Product(s) shall be installed according to Customer’s reasonable instructions (as conveyed to Supplier by Distributor).
Delivery Conditions. All deliveries of Products pursuant to this Agreement shall be FOB Supplier’s port of shipment, as defined in Incoterms 2010. Risk and title to the Products shall pass to Silk Road Medical as defined by such Incoterm. Transport of all Products shall be performed by a service provider selected and contracted by Silk Road Medical. Alternative transport is permitted only after written approval of Silk Road Medical. Silk Road Medical may request that Supplier ship Products by premium freight. In the event Supplier pays any related freight charges, such charges shall be invoiced to Silk Road Medical and Silk Road Medical shall reimburse Supplier for such charges.
Delivery Conditions. 3.1. The seller is obliged to deliver the goods to the buyer without any delay, at the latest by 30 days from the date of conclusion of the contract unless agreed otherwise in the contract. If the seller fails to fulfil the obligation the buyer has the rights to appeal for the goods to be delivered within the time requested by the buyer. Delivery within 30 days does not apply for the wholesale consumers and companies, where written agreement for delivery dates must be made depending on actual stock supply and production length. If seller fails to fulfil the obligation in additional deadline, then the buyer has got the rights to back out of the contract.
Delivery Conditions. 9.1. Delivery of products must be made in accordance with the instructions appearing on the official purchase order.
Delivery Conditions. All times, dates and delivery deadlines are consid- ered non-binding, unless their binding nature has been expressly agreed in writing. Binding delivery deadlines and dates that have been agreed upon in writing are met when the product is made avail- able in the distributing warehouse before the corresponding dates have passed. If BELIMO has a delay in delivery, it is assumed that the client continues to demand the delivery. Compensation for late delivery or for replacement is excluded. If not otherwise indicated on the order confirma- tion, delivery of the Goods shall be made in accordance with Incoterms® 2020 DAP Goods re- cipient (DAP = Delivered At Place, delivery address ship-to-party) BELIMO reserves the right not to deliver the or- dered products if they are unavailable; in this case, XXXXXX will immediately notify the client of the non-availability and, if necessary, reimburse any payment already made.
