EXTENSION OF TIME FOR PERFORMANCE. 13.1 If performance by the Contractor is delayed for a reason set forth in Article 13.3, the Contractor may be allowed a reasonable extension of time in conformance with this Article 13 and the PPB Rules.
EXTENSION OF TIME FOR PERFORMANCE. No extension of time granted hereunder shall release the DB Contractor’s Surety from its obligations. The District shall not be deemed to have waived any rights under the Contract, including its right to abrogate the Contract for abandonment or for failure to complete within the time specified, or to impose and deduct damages as may be provided herein as the result of any grant of an extension of time beyond the date fixed for the completion of any part of the Work, any acceptance of performance of any part of the Work after a Completion Deadline, or the making of any payments to the DB Contractor after such date.
EXTENSION OF TIME FOR PERFORMANCE. 16.1 Upon written application by the Contractor, the Agency Chief Contracting Officer may grant an extension of time for performance of the Contract. Said application, must state, at a minimum, in detail, each cause for delay, the date the cause of the alleged delay occurred and the total number of delay in days attributable to such cause.
EXTENSION OF TIME FOR PERFORMANCE. If this Agreement calls for any action to be taken on or by a date which is not a Business Day, such action shall be deemed to be required to be taken on or by the next succeeding Business Day.
EXTENSION OF TIME FOR PERFORMANCE. The time for performance of any obligation affected by force majeure as contemplated in this Article shall be extended for such period as is reasonable, having regard to all the circumstances of the case, provided however that if that delay exceeds more than three (3) months, the non- subjected party shall be entitled without granting any additional extension to terminate the Agreement upon thirty (30) days prior written notice and the provisions of Article 14 shall apply to such termination.
EXTENSION OF TIME FOR PERFORMANCE. If a party's performance of any obligation or exercise of any option under this Agreement might reasonably be expected to be affected by the prior determination of the purchase price and the purchase price cannot administratively be determined within the period of time specified, then the period of time within which such action must be taken will be extended to the date fifteen (15) days after the date on which the purchase price is determined.
EXTENSION OF TIME FOR PERFORMANCE. If the Department agrees that the delay or anticipated delay is attributable to a force majeure, the time for performance of the obligations under this Consent Decree that are affected by the force majeure will be extended by the Department for such time as is necessary to complete those obligations. An extension of the time for performance of the obligations affected by the force majeure shall not, of itself, extend the time for performance of any other obligation. If the Department does not agree that the delay or anticipated delay has been or will be caused by a force majeure, the Department will notify Work Parties in writing of its decision. If the Department agrees that the delay is attributable to a force majeure, the Department will notify the Work Parties, in writing of the length of the extension, if any, for performance of the obligations affected by the force majeure.
EXTENSION OF TIME FOR PERFORMANCE. Whenever a period of time is designated within which a Party hereto is required to do or complete any act, matter or thing, the time for the doing or completion thereof shall be extended by a period of time equal to the number of days during which such Party is actually prevented from, or is unreasonably interfered with, the doing or completion of such act, matter, or thing because of causes beyond the reasonable control of the Party to be excused, including war, insurrection, riots, floods, earthquakes, fires, casualties, acts of G-d, or similar grounds for excused performance that are not within the reasonable control of the Parties to be excused (financial inability excepted).
EXTENSION OF TIME FOR PERFORMANCE. No Completion Deadline extension hereunder shall release Contractor, Contractor’s Surety, or any Guarantor from its obligations. VPRA shall not be deemed to have waived any rights under the Contract (including its right to abrogate the Contract for abandonment or for failure to complete within the time specified, or to impose and deduct damages as may be provided herein) as the result of any grant of an extension of a Completion Deadline beyond the date fixed for the completion of any part of the Work, any Acceptance of performance of any part of the Work after a Completion Deadline, or the making of any payments to Contractor after such date.
EXTENSION OF TIME FOR PERFORMANCE. If the SELLER cannot convey title as required by this Agreement or cannot deliver possession of the Premises as agreed, or if at the time of the delivery of the deed the Premises do not conform with the requirements set forth in this Agreement, upon written notice given no later than the time for performance from either party to the other, the time for performance shall be automatically extended for thirty (30) days, except that if BUYER'S mortgage commitment expires or the terms will materially and adversely change in fewer than thirty (30) days, the time for performance set forth in paragraph 5 shall be extended to one business day before expiration of the mortgage commitment. SELLER shall use reasonable efforts to make title conform or to deliver possession as agreed, or to make the Premises conform to the requirements of this Agreement. Excluding discharge of mortgages and liens, about which the SELLER has actual knowledge at the time of signing this Agreement, the SELLER shall not be required to incur costs or expenses totaling in excess of ($ ) to make the title or the Premises conform or to deliver possession as agreed. If at the expiration of the time for performance, or if there has been an extension, at the expiration of the time for performance as extended, the SELLER, despite reasonable efforts, cannot make the title or Premises conform, as agreed, or cannot deliver possession, as agreed, then, at the BUYER'S election, any payments made by the BUYER pursuant to this Agreement shall be immediately returned. Upon return of all such funds, all obligations of the BUYER and SELLER shall terminate and this Agreement shall automatically become void and neither the BUYER nor SELLER shall have further recourse or remedy against the other.
