Common use of Expiry period Clause in Contracts

Expiry period. 1. All mutual claims arising from this Agreement and such claims that are associated with this contractual relationship will lapse if they are not enforced in writing to the relevant contracting party (§ 126 b of the German Civil Code [BGB]) within six months of their due date. The limitation period does not apply: (1) to liability based on intent, (2) to damages resulting from injury to life, body, or health, or (3) to claims of the contracting party that are legally exempt from a limitation period (such as under MiLoG).
