Common use of EXPENSE PROVISION Clause in Contracts

EXPENSE PROVISION. Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Class, such that the ordinary operating expenses incurred by the Investor Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.20% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Class.

EXPENSE PROVISION. Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Class, such that the ordinary operating expenses incurred by the Investor Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.200.10% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Class.

Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Class, such that the ordinary operating expenses incurred by the Investor Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.200.19% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Class.

Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Institutional Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Institutional Class, such that the ordinary operating expenses incurred by the Investor Institutional Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Independent Trustees of the Trust, and extraordinary expenses) will not exceed 0.20% 4 basis points on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Institutional Class.

EXPENSE PROVISION. Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Institutional Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Institutional Class, such that the ordinary operating expenses incurred by the Investor Institutional Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.200.06% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Institutional Class.

EXPENSE PROVISION. Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Class, such that the ordinary operating expenses incurred by the Investor Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.200.16% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Class.

Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Class, such that the ordinary operating expenses incurred by the Investor Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.200.33% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Class.

For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Institutional Class.

For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Class.

For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Institutional Class.

EXPENSE PROVISION. Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Class, such that the ordinary operating expenses incurred by the Investor Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.200.17% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Class.

For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Institutional Class.

Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Class, such that the ordinary operating expenses incurred by the Investor Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Independent Trustees of the Trust, and extraordinary expenses) will not exceed 0.20% 21 basis points on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Class.

Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Institutional Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Institutional Class, such that the ordinary operating expenses incurred by the Investor Institutional Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.200.15% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Institutional Class.

EXPENSE PROVISION. Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Class, such that the ordinary operating expenses incurred by the Investor Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.200.34% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Class.

For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Institutional Class Class.

Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Institutional Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Institutional Class, such that the ordinary operating expenses incurred by the Investor Institutional Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.200.17% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Institutional Class.

Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Institutional Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Institutional Class, such that the ordinary operating expenses incurred by the Investor Institutional Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.200.04% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Institutional Class.

Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Institutional Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Institutional Class, such that the ordinary operating expenses incurred by the Investor Institutional Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.200.23% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Institutional Class.

EXPENSE PROVISION. Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Class, such that the ordinary operating expenses incurred by the Investor Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.200.36% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Class.

EXPENSE PROVISION. Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Class, such that the ordinary operating expenses incurred by the Investor Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Independent Trustees of the Trust, and extraordinary expenses) will not exceed 0.20% 22 basis points on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Class.

EXPENSE PROVISION. Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Class, agrees to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor ClassRetail Fund, such that the ordinary operating expenses incurred by the Investor Class Retail Fund in any fiscal year (excluding interest, taxes, securities lending costsand extraordinary expenses, as well as non-operating expenses such as brokerage commissions, commissions and fees and expenses of associated with the disinterested Trustees of the TrustFund’s securities lending program, and extraordinary expensesif applicable) will not exceed 0.200.45% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than Advisor Class of the Investor ClassFund.

EXPENSE PROVISION. Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Institutional Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Institutional Class, such that the ordinary operating expenses incurred by the Investor Institutional Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Independent Trustees of the Trust, and extraordinary expenses) will not exceed 0.20% 6 basis points on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Institutional Class.

Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Institutional Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Institutional Class, such that the ordinary operating expenses incurred by the Investor Institutional Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Independent Trustees of the Trust, and extraordinary expenses) will not exceed 0.20% 7 basis points on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Institutional Class.

Until this agreement shall be amended or terminated pursuant to Section 2 or Section 5 hereof, the Manager agrees, with respect to the Investor Class, to pay or provide for the payment of any fee or expense allocated at the class level and attributable to the Investor Class, such that the ordinary operating expenses incurred by the Investor Class in any fiscal year (excluding interest, taxes, securities lending costs, brokerage commissions, fees and expenses of the disinterested Trustees of the Trust, and extraordinary expenses) will not exceed 0.200.46% on an annual basis. For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Class.

For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Institutional Class.

For avoidance of doubt, it is understood that this agreement shall not apply to any other class other than the Investor Class.
