Common use of Expansions Clause in Contracts

Expansions. a. If the Customer wishes to make expansions to Leviy, discussions will take place between the parties. The expansions will be carried out at the Fixed Hourly Rate or, if agreed upon, at a mutually agreed fixed contract amount. b. A yearly Budget may be established between the parties. If a Budget is in place, the Provider will maintain a record of the hours used. The Maximum Number of Hours within this Budget is the amount of the Budget divided by the Fixed Hourly Rate. Once the Maximum Number of Hours has been reached, the Provider will inform the Customer. The parties may then agree to increase the Budget or reconcile the additional hours according to the Fixed Hourly Rate. The Provider will not continue with expansions until written approval has been given by the Customer. The Budget is non-transferable to the following contract year. No refund will be provided if the Budget is not fully used.
