Common use of Existing Studies Clause in Contracts

Existing Studies. (a) The Parties acknowledge that, as of the Effective Date, the Existing Studies are being conducted on behalf of the Seller and following the Effective Date, as between the Parties, the Seller shall have the sole right to conduct such studies. Without limiting the foregoing, the Parties acknowledge and agree that the APeX-T Study is in the process of being terminated and wound down and will be terminated as of or following the Effective Date. (b) The Parties shall, through the JSC, discuss and review any material updates with respect to the conduct of any Existing Studies.
