Exempt Contracts. Contracts subject to federal or state law or regulations that preclude the applicability of this Section’s requirements shall be exempt from such requirements.

SUB-CONTRACTS (a) The Servicer may sub-contract or delegate the performance of all or any of its powers and obligations under this Agreement, provided that (but subject to Section 3.2(b)):
Existing Contracts Billing terms and provisions contained in existing contracting entity agreements (existing as of the date this policy is approved by the Board of Supervisors) shall remain in effect for the life of the contract. However, when these existing contracts are renegotiated, they shall contain the billing provisions as set forth in this policy.

GOVERNMENT CONTRACTS Except as set forth in Disclosure Schedule (3.20), as of the Closing Date, no Credit Party is a party to any contract or agreement with any Governmental Authority and no Credit Party’s Accounts are subject to the Federal Assignment of Claims Act (31 U.S.C. PUBLIC CONTRACTS WITH NATURAL PERSONS 24-76.5-101, et seq., C.R.S.
