Executive’s Continuing Obligations to Xxxxxxxx Creek and Agreement Not to Disparage Xxxxxxxx Creek. Executive acknowledges and agrees that Executive has, and will abide by, continuing obligations to Xxxxxxxx Creek, including the obligations set forth in Executive's Amended and Restated Employment Agreement. Executive further acknowledges and agrees that by reason of Executive's position with Xxxxxxxx Creek, Executive was given access to confidential information, including trade secret information, with respect to the business affairs of Xxxxxxxx Creek. Executive represents that Executive has held all such information confidential and will continue to do so. Executive has not retained any confidential information or documents, including but not limited to trade secret information, obtained as a result of or in connection with Executive's employment. Further, Executive will not defame, slander or otherwise disparage Xxxxxxxx Creek, its business, or its representatives.
