Common use of Exception Clause in Contracts

Exception. Nothing in clause 12.2 shall entitle any Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss to the extent that the same is the subject of an additional payment under clause 6.6.

Nothing in clause 12.2 shall entitle any the Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss (a) to the extent that the same is taken into account in calculating the Additional Cost or (b) to the extent that the same is the subject of an additional payment under clause 6.6.

Exception. Nothing in clause 12.2 Clause 12.3 shall entitle any the Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss to the extent that the same is the subject of an additional payment under clause 6.6Clause 5.3.

Exception. Nothing in clause 12.2 shall entitle any Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss to the extent that the same is the subject of an additional payment under clause 6.66.7.

Exception. Nothing in clause 12.2 13.2 shall entitle any the Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss (a) to the extent that the same is taken into account in calculating the Additional Cost or (b) to the extent that the same is the subject of an additional payment under clause 6.67.6.

Exception. Nothing in clause 12.2 12 shall entitle any Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss to the extent that the same is the subject of an additional payment under clause 6.6.

Exception. Nothing in clause 12.2 shall entitle any Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional costcosts, reduction, payment, foregone payment or foregoing return or loss to the extent that the same is the subject of an additional payment under clause 6.66.7 or is taken into account in calculating the Additional Cost.

Exception. Nothing in clause 12.2 shall entitle any Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss to the extent that the same (a) is taken into account in calculating Mandatory Cost or (b) is the subject of an additional payment under clause 6.6.

Exception. 12.3.1 Nothing in clause 12.2 shall entitle any Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss to the extent that the same is the subject of an additional payment under clause 6.6. 12.3.2 Nothing in clause 12.2 shall entitle any Bank to receive any amount in respect of compensation for a FATCA Deduction required to be made by a Party.

Exception. Nothing in clause 12.2 shall entitle any a Bank or the Issuing Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss to the extent that the same is the subject of an additional payment under clause 6.6.

Exception. Nothing in clause 12.2 shall entitle any Notifying Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss to the extent that the same is the subject of an additional payment under clause 6.6.

Exception. Nothing in clause 12.2 13.2 shall entitle any the Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss to the extent that the same is (a) taken into account in calculating the Additional Cost or (b) the subject of an additional payment under clause 6.67.6.

Exception. Nothing in clause 12.2 shall entitle any Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss to the extent that the same is the subject of an additional payment under clause 6.66.6.1.

Exception. Nothing in clause 12.2 Clause 17.2 shall entitle any Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional costcosts, reduction, payment, foregone payment or foregoing return or loss to the extent that the same is the subject of an additional payment under clause 6.6Clause 7.7.

Nothing in clause 12.2 shall entitle any Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss to the extent that the same is (a) taken into account in calculating the Mandatory Cost or (b) the subject of an additional payment under clause 6.6.

Nothing in clause 12.2 shall entitle any Bank or the Issuing Bank to receive any amount in respect of compensation for any such liability to Taxes, increased or additional cost, reduction, payment, foregone return or loss to the extent that the same is the subject of an additional payment under clause 6.6.
