Common use of Except for those Noticed Clause in Contracts

Except for those Noticed. Class Members who timely and properly file a Request for Exclusion in accordance with Section 11, all Noticed Class Members will be deemed to be RoundPoint Settlement Class Members for all purposes under the Agreement, and upon the Effective Date, will be bound by the terms of this Settlement, regardless of whether they received the Mail Notice of the Settlement, whether they had knowledge of the Settlement, or whether they received Claim Settlement Relief or any other relief.
