Common use of Example 2 Clause in Contracts

Example 2. An employee on the 3/12.5 work schedule works a regular schedule of 75 hours in a pay period and is assigned to work, in the same pay period, 10 of the 10 “payback” hours owed to the City during a 28-day work period; such employee shall not earn overtime compensation during the pay period until hours worked during the pay period exceed 85 hours. In this example, the 10 “payback” hours owed to the City and worked during the pay period would not receive additional compensation, but would count toward reaching the minimum 80-hour threshold for calculating overtime compensation. However, because the employee owes 10 hours back to the City, the employee would only be compensated at time and one-half for hours worked in excess of 85 hours during the pay period. Ten “payback” hours are owed to the City during each 28-day work period because the 3/12.5 work schedule employee was paid for those hours in advance at the rate of 5 hours for each of the 2 pay periods in a 28-day work period.
