Common use of Evaluation Access Clause in Contracts

Evaluation Access. If Tableau has made available to you free, trial or evaluation access to Tableau Online (“Evaluation Access”), you may use such access solely for the purpose of evaluating Tableau Online to determine whether to purchase a subscription from Tableau. You may not use Evaluation Access for any other purposes, including but not limited to competitive analysis, commercial, professional or for-profit purposes. Evaluation Access is limited to fourteen (14) days from the date you activate your Evaluation Access, unless otherwise specified by Tableau in the applicable Ordering Document or a separate writing from Tableau (“Evaluation Period”). Unless you purchase a subscription for Tableau Online, your Evaluation Access maybe terminated and, in any event your right to access and use Tableau Online automatically expires at the end of the Evaluation Period. Upon any termination or expiration of the Evaluation Period, your Evaluation Access will cease and you will no longer have access to any Customer Data used in connection with such Evaluation Access. Notwithstanding any other provision of this Agreement, Evaluation Access is provided “AS IS” without warranty or support of any kind, express or implied. Tableau may terminate your Evaluation Access at any time for any reason and without liability of any kind. IF YOU SUBSEQUENTLY PURCHASE A SUBSCRIPTION TO TABLEAU ONLINE, YOUR EVALUATION ACCESS SHALL IMMEDIATELY TERMINATE AND YOU EXPRESSLY AGREE THAT, UNLESS YOU HAVE A SEPARATE SIGNED AGREEMENT GOVERNING YOUR ACCESS TO AND USE OF TABLEAU ONLINE, THIS AGREEMENT, AND THE TERMS AND CONDITIONS HEREIN, SHALL GOVERN YOUR USE OF SUCH NON-EVALUATION VERSION.

If Tableau Timetta has made available to you free, trial or evaluation access to Tableau Online Timetta (“Evaluation Access”), you may use such access solely for the purpose of evaluating Tableau Online Timetta to determine whether to purchase a subscription from TableauTimetta. You may not use Evaluation Access for any other purposes, including but not limited to competitive analysis, commercial, professional or for-profit purposes. Unless you purchase a subscription for Tableau OnlineTimetta, your Evaluation Access maybe may be terminated and, in any event your right to access and use Tableau Online Timetta automatically expires at the end of the Evaluation Period. Upon any termination or expiration of the Evaluation Period, your Evaluation Access will cease and you will no longer have access to any Customer Data used in connection with such Evaluation Access. Notwithstanding any other provision of this Agreement, Evaluation Access is provided “AS IS” without warranty or support of any kind, express or implied. Tableau Timetta may terminate your Evaluation Access at any time for any reason and without liability of any kind. IF YOU SUBSEQUENTLY PURCHASE A SUBSCRIPTION TO TABLEAU ONLINETIMETTA, YOUR EVALUATION ACCESS SHALL IMMEDIATELY TERMINATE AND YOU EXPRESSLY AGREE THAT, UNLESS YOU HAVE A SEPARATE SIGNED AGREEMENT GOVERNING YOUR ACCESS TO AND USE OF TABLEAU ONLINETIMETTA, THIS AGREEMENT, AND THE TERMS AND CONDITIONS HEREIN, SHALL GOVERN YOUR USE OF SUCH NON-EVALUATION VERSION.

You may not use Customer hereby accepts this Agreement by accepting Evaluation Access for any other purposes, including but not limited to competitive analysis, commercial, professional or for-profit purposesthe Evaluation Products (defined below). In the event Customer has been granted Evaluation Access by Checkmarx, Checkmarx hereby grants Customer a non-exclusive, non- transferable, non-sublicensable license to access and use the Software or features (the “Evaluation Products”) for Customer’s internal, non-production, evaluation purposes only, during the evaluation period designated by Checkmarx (the “Evaluation Period”). If no Evaluation Period is limited to specified in writing by Checkmarx, the Evaluation Period shall be fourteen (14) days from first delivery of the date you activate your Software or license keys by Checkmarx, whichever occurs first. This evaluation license does not grant any rights whatsoever to the source code of the Evaluation AccessProducts. Title to and ownership of all right, unless otherwise specified by Tableau title, and interest in and to the applicable Ordering Document or a separate writing from Tableau (“Evaluation Period”)Products will at all times be and remain with Checkmarx and its Affiliates and licensors. Unless you purchase a subscription for Tableau Online, your Evaluation Access maybe terminated andis subject to all restrictions set forth in this Agreement. All rights not expressly granted herein are reserved by Checkmarx. All Evaluation Products are offered on an “AS-IS” basis without any warranty, in and Checkmarx shall have no indemnification obligations or liability with respect to the Evaluation Products. Customer assumes all risks and all costs associated with its use of the Evaluation Products. Customer acknowledges that Checkmarx may choose not to release any event your right to access and use Tableau Online automatically expires at beta or prerelease features or functionality as part of any future general release versions. At the end of the Evaluation Period. Upon any termination or expiration , if Customer chooses not to enter into a definitive agreement with Checkmarx with respect to the Evaluation Products, Customer will promptly cease use of the Evaluation PeriodProducts and shall, your as applicable, destroy all copies of the Evaluation Access will cease Products and you will no longer have access to any Customer Data used in connection with such Evaluation Access. Notwithstanding any other provision of this Agreement, Evaluation Access is provided “AS IS” without warranty or support of any kind, express or implied. Tableau may terminate your Evaluation Access at any time for any reason and without liability of any kind. If Tableau Next Limit has made available to you free, trial or evaluation access to Tableau Online BEGRAPH (“Evaluation Access”), you may use such access solely for the purpose of evaluating Tableau Online BEGRAPH to determine whether to purchase a subscription from TableauNext Limit. You may not use Evaluation Access for any other purposes, including but not limited to competitive analysis, commercial, professional or for-profit purposes. Evaluation Access is limited to fourteen five (145) days from the date you activate your Evaluation Access, unless otherwise specified by Tableau Next Limit in the applicable Ordering Document or a separate writing from Tableau Next Limit (“Evaluation Period”). Unless you purchase a subscription for Tableau OnlineBEGRAPH, your Evaluation Access maybe may be terminated and, in any event your right to access and use Tableau Online BEGRAPH automatically expires at the end of the Evaluation Period. Upon any termination or expiration of the Evaluation Period, your Evaluation Access will cease and you will no longer have access to any Customer Data used in connection with such Evaluation Access. Notwithstanding any other provision of this Agreement, Evaluation Access is provided “AS IS” without warranty or support of any kind, express or implied. Tableau Next Limit may terminate your Evaluation Access at any time for any reason and without liability of any kind. IF YOU SUBSEQUENTLY PURCHASE A SUBSCRIPTION TO TABLEAU ONLINEBEGRAPH, YOUR EVALUATION ACCESS SHALL IMMEDIATELY TERMINATE AND YOU EXPRESSLY AGREE THAT, UNLESS YOU HAVE A SEPARATE SIGNED AGREEMENT GOVERNING YOUR ACCESS TO AND USE OF TABLEAU ONLINEBEGRAPH, THIS AGREEMENT, AND THE TERMS AND CONDITIONS HEREIN, SHALL GOVERN YOUR USE OF SUCH NON-NON- EVALUATION VERSION.

You may not use Evaluation Access for any other purposes, including but not limited to competitive analysis, commercial, professional or for-profit purposes. Evaluation Access is limited to fourteen (14) days from the date you activate your Evaluation Access, unless otherwise specified by Tableau Field Dynamics in the applicable Ordering Document or a separate writing from Tableau Field Dynamics (“Evaluation Period”). Unless you purchase a subscription for Tableau Online, your Evaluation Access maybe may be terminated and, in any event your right to access and use Tableau Online automatically expires at the end of the Evaluation Period. Upon any termination or expiration of the Evaluation Period, your Evaluation Access will cease and you will no longer have access to any Customer Data used in connection with such Evaluation Access. Notwithstanding any other provision of this Agreement, Evaluation Access is provided “AS IS” without warranty or support of any kind, express or implied. Field Dynamics or Tableau may terminate your Evaluation Access at any time for any reason and without liability of any kind. IF YOU SUBSEQUENTLY PURCHASE A SUBSCRIPTION TO TABLEAU ONLINE, YOUR EVALUATION ACCESS SHALL IMMEDIATELY TERMINATE AND YOU EXPRESSLY AGREE THAT, UNLESS YOU HAVE A SEPARATE SIGNED AGREEMENT GOVERNING YOUR ACCESS TO AND USE OF TABLEAU ONLINE, THIS AGREEMENT, AND THE TERMS AND CONDITIONS HEREIN, SHALL GOVERN YOUR USE OF SUCH NON-EVALUATION VERSION.

If Tableau Xpand IT has made available to you free, a free trial or evaluation access to Tableau Online Write-Back Cloud Product (“Evaluation Access”), you may use such access solely for the purpose of evaluating Tableau Online Write-Back Cloud Product to determine whether to purchase a subscription from TableauXpand IT. You The Customer may not use Evaluation Access for any other purposes, including but not limited to competitive analysis, commercial, professional professional, or for-profit purposes. Evaluation Access is limited to fourteen thirty (1430) days from the date you activate your Evaluation Access, Access unless otherwise specified by Tableau Xpand IT in the applicable Ordering Document or a separate writing from Tableau form (“Evaluation Period”). Unless you purchase the Customer purchases a subscription for Tableau OnlineWrite-Back Cloud Product, your the Customer’s Evaluation Access maybe terminated may be terminated, and, in any event your event, the Customer's right to access and use Tableau Online Write-Back Cloud Product automatically expires at the end of the Evaluation Period. Upon any termination or expiration of the Evaluation Period, your the Customer’s Evaluation Access will cease cease, and you the Customer will no longer have access to any Customer Data used in connection with such Evaluation Access. Notwithstanding any other provision of this Agreement, Evaluation Access is provided “AS IS” without warranty or support of any kind, express or implied. Tableau Xpand IT may terminate your the Customer’s Evaluation Access at any time for any reason and without liability of any kind. IF YOU THE CUSTOMER SUBSEQUENTLY PURCHASE PURCHASES A SUBSCRIPTION TO TABLEAU ONLINEOF A WRITE-BACK CLOUD PRODUCT, YOUR THE CUSTOMER’S EVALUATION ACCESS SHALL IMMEDIATELY TERMINATE AND YOU THE CUSTOMER EXPRESSLY AGREE THAT, UNLESS YOU HAVE THE CUSTOMER HAS A SEPARATE SIGNED AGREEMENT GOVERNING YOUR THE CUSTOMER’S ACCESS TO AND USE OF TABLEAU ONLINEWRITE-BACK CLOUD PRODUCT, THIS AGREEMENT, AND THE TERMS AND CONDITIONS HEREIN, SHALL GOVERN YOUR THE CUSTOMER’S USE OF SUCH NON-EVALUATION VERSION.
